The couple has issued a joint statement, posted on his Facebook page, that reads, “Despite misleading reports in the press, we are happily together. Now in our 23rd year of marriage, we’re looking forward to many more.”

According to the New York Post‘s Page Six website, the 67-year-old Rock and Roll Hall of Famer was charged with one count of assault and one count of harassment after he allegedly became physically abusive toward his wife at their New York City apartment.  Page Six reported that, according to a criminal claim filed by police, the incident began as a verbal dispute but escalated, with Fagen eventually shoving Titus into a marble window frame, causing her right arm to bruise and swell.

Titus told the Post in a phone interview after the January 4 incident, “I don’t feel good…I’m very tired and I’m divorcing my husband.”  Fagen was arraigned the next day in a Manhattan court, then was released without bail.  His wife received an order of protection against him.

Page Six also reports that this past Monday, Fagen was back in court, where prosecutors agreed to dismiss the charges, as long as Donald gets into no further trouble during the next year.

Fagen and Titus have been married since 1993, although they first met during the 1960s when they both attended Bard College.  Libby previously had a long-term relationship with late Band singer/drummer Levon Helm, with whom she had a daughter, Amy Helm, in 1970.
